Cohabitation

Where a relationship between an unmarried couple breaks down, the division of assets is often more complicated especially when, for example, property is held in one party’s sole name. At the outset of such a relationship we can help by advising on a Living Together agreement and liaising closely with our Private Client and Conveyancing Departments to ensure adequate protection.

Despite the coverage in the media surrounding the introduction of the Civil Partnership Act on 5th December 2005, as yet heterosexual couples are unable to benefit from the usual financial remedies available to divorcing couples, although the Law Commission has put forward draft proposals for change on which they are due to report finally in the summer of 2007. Currently the resolution of financial disputes between cohabitees is governed by complex and often archaic principles of property, trust and contract law.

We offer straightforward advice to cohabitees both before entering into such relationships and also should they break down, and if necessary can bring proceedings to secure their share of joint assets.
